The Peter Kittle Motor Company is required to comply with the Privacy Act 1988 (Act) and is subject to the Australian Privacy Principles (APPs) contained in the Act.

This Privacy and Credit Reporting Policy (Policy) is intended to describe how we handle your personal information that is collected by us. Your 'personal information' as used in this Policy, refers to any information or opinion about you that is capable of identifying you and includes 'credit related information' which is defined in this Policy to include credit information, credit eligibility information and CP-derived information as those terms are defined in the Act which relates to you.

By using any of our websites and/or providing your personal information to us you consent to us handling your personal information which as noted above includes credit related information, in accordance with this Policy.

OneToyota Network

The Peter Kittle Motor Company is part of the OneToyota network of Toyota organisations in Australia (each a OneToyota organisation), comprising:

  • authorised Toyota dealers in Australia;
  • Toyota Motor Corporation Australia Limited;
  • Toyota Finance Australia Limited;
  • Aioi Nissay Dowa Insurance Company Australia Pty Ltd trading as Toyota Insurance; and
  • Toyota Western Australia (comprising Prestige Motors Pty Ltd as trustee for the Prestige Toyota Unit Trust and Eastpoint Pty Ltd).

The Peter Kittle Motor Company and other OneToyota organisations collect and share with each other customer and guest information, including data collected from Connected Services to provide you an integrated OneToyota guest experience, such as allowing you to be known across the network regardless of which OneToyota organisation you deal with and to provide you with products, services, information and assistance, respond to your enquiries and help keep your information up to date. Your information may be disclosed to OneToyota network service providers in Australia and overseas for these purposes.

OneToyota Marketing

OneToyota organisations may send you marketing to inform you about products or services, special offers, promotions and events that may be of interest to you. These marketing communications may include joint promotions with promotion partners, and may be sent to you using any contact details provided by you, such as post, phone, email or SMS.

Please note that each of the OneToyota organisations are separate organisations. If you do not wish to receive marketing from one organisation, you can let that organisation know at any time using the contact details in their privacy policy (available on their website or toyota.com.au/privacy) or using the “unsubscribe” or other opt-out function offered by the organisation.

Your consent to receive marketing from a OneToyota organisation will be deemed to be ongoing if you do not opt out when you are offered the opportunity to do so, or unless and until you advise the relevant organisation otherwise.

How We Collect Your Personal Information

The types of personal information we collect about you, and our use of that information depends on our dealings with you. Generally, this personal information will include (but is not limited to) your name, address, telephone number, email address, date of birth, motor vehicle drivers license, details of your vehicle and any vehicles that you have enquired about, ordered or which we service for you, and your payment and delivery details.

In addition, where you apply for a credit account, guarantee a credit account or apply for finance products through us, the kinds of credit related information we collect and hold may include:

  • information regarding the credit you apply for, or obtain, for instance:
    • the type and amount of credit and the terms upon which credit is extended;
    • credit liability information;
    • repayment history information and default information;
    • the date credit is obtained and the period for which it is obtained;
  • information relating to your creditworthiness for instance:
    • insolvency information;
    • credit infringement information; and
    • legal actions regarding your past or present credit arrangements; and
    • employment details, statements of assets and liabilities, the length of time you have been in business and details of recent credit applications made.

We may collect the personal information you directly give us through some of the following means:

(a) if you:

(i) purchase a new or used motor vehicle through our purchase contracts;

(ii) lease a vehicle from us through our leasing contracts;

(iii) apply for finance or insurance through us or apply for credit with us;

(iv) are one of our suppliers;

(v) subscribed to our mailing list or newsletter;

(vi) submit an application for employment with us;

(vii) make an inquiry, submit a form or order in relation to products or services through the Website or to us directly;

(viii) contact us via telephone, facsimile, email or other correspondence (whether in writing or electronically); and

(b) in administering and performing any contracts with service providers;

(c) while conducting customer satisfaction and market research surveys;

(d) when administering any of our services; and

(e) as otherwise required to manage our business.

We also collect personal information from third parties, for example from our related entities and dealerships, suppliers, finance or insurance companies providing related services to you, credit reporting bodies, from your representative, from a customer (e.g. your spouse) who nominates you as the delivery address for a vehicle, from your credit provider or from publicly available sources).

Generally, reports from credit reporting bodies will set out your credit history with other credit providers. We may also collect and hold scores, ratings, summaries, evaluations, and other information related to your creditworthiness as provided by credit reporting bodies or derived by us from information collected from these credit reporting bodies

We will limit the personal information we collect to that which is necessary for our functions or activities. We generally will not collect sensitive information about you such as medical information and records unless it is reasonably necessary for the purpose of providing you with a specific product or service or is otherwise permitted by law.

Generally, if we are unable to collect the personal information we require we may not be able to provide you with the products and services you seek, or where the information is incorrect or incomplete this may affect the quality of the service we provide to you.

Storage of Your Personal Information

We take reasonable steps to store your personal information securely. It is kept in secure locations either in secure physical records, electronically on our intranet system, in cloud storage, and in some cases, records on third party servers, which may be located overseas. Access to the information is restricted to those who have the appropriate authorization under our policies and procedures which are intended to protect your personal information from unauthorised access, modification and disclosure, and from other types of misuse, interference and loss. Where we share the information with third parties we ensure they also have appropriate policies and security in place.

We conduct regular monitoring and improvement of our practices and systems to ensure the effectiveness of our security policies.

We will take reasonable steps to destroy or permanently de-identify your personal information including any credit card details and bank account details when we no longer require it for any purpose for which it was collected. We may retain your personal information for as long as necessary to comply with any applicable law, for insurance and governance purposes, in case of vehicle or product recall, for future marketing and promotional purposes, for the prevention of fraud and to resolve disputes. Your personal information may be retained in our IT system back-up records.

Use and Disclosure of Your Personal Information

We will use and disclose your personal information for the purpose for which we collected it, and for related purposes that we consider you would reasonably expect.

Generally, these purposes include:

  • responding to your enquiries;
  • providing you with our products and services;
  • providing you with marketing information or special offers for our products and services;
  • enable us to assess an application for a credit facility and maintain a credit account;
  • assessing credit guarantees (current and prospective);
  • collecting overdue payments;
  • reviewing existing credit terms;
  • providing you with vehicle service reminders;
  • conducting market research;
  • obtaining your feedback on your customer experience; and
  • our general business operations (for example, maintenance of our business records, insurance purposes, compliance with our legal obligations and statistical purposes).

By providing us with your personal information, you consent to us using your personal information for these purposes. You agree that we may send you information on our products and services and or for the purposes noted above, by post or by electronic means (including e-mail and SMS). You can opt-out of marketing and promotional communications at any time by contacting our Privacy Officer via the details shown below.

Otherwise, we will seek your consent prior to using or disclosing your personal information for another purpose, unless we are required or permitted by law to do so without seeking your permission.

Disclosure of Personal Information

We may exchange your personal information within the Peter Kittle Motor Company and our related entities. We may also disclose your personal information to our agents and contractors for the purposes set out above, and for the purposes of those parties providing services to us or performing business services or functions on our behalf. Where we disclose your personal information to certain contractors or subcontractors of ours that provide administrative or promotional services to us ( for example, mail processing businesses, debt collection bodies, printers, or market research companies), we enter into contractual agreements with these organisations to ensure that the information we disclose is used only for the limited purposes for which we have provided it.

We may disclose your personal information to motor vehicle distributors, manufacturers, financiers or other related suppliers in the provision of supplying our products and services to you, and they may get in contact with you for purposes that relate to safety, promotional, market research and other matters relating to motor vehicles and you.

We may also disclose your personal information to a credit reporting body, to another supplier if they hold your consent to obtain a reference or to a debt collector or solicitor in the event of default by you of any credit facilities with us. These parties may disclose your personal information to certain organisations for the purposes outlined above.

You may be asked for consent to appear in our social media publications when you attend one of our events, or when your new vehicle is delivered. If you agree to appear in our social media, photographs or videos of you may be placed on our social media feeds. Some of this information may be hosted outside Australia by the social media organisations. If you ask, we will remove material about you from our feeds by deleting the posts, it is possible that the social media organisation or users of the social media platform may have retained copies from the service or re packaged and re posted them. The social media organisations have their own privacy and "take down" policies covering this.

We will not use or disclose your personal information for any other purpose other than as disclosed in this policy unless you have consented to that use or disclosure.

Our Websites

When you use the website of any our dealerships it is automatically linked to our website at www.peterkittle.com.au which automatically collects various items of information, including:

  • your IP ("Internet Protocol") address (which, in general terms, is a unique identifier
  • assigned to your computer when it is connected to the Internet);
  • the operating system and Internet browser software you are currently using; and
  • the data that you download (such as web pages or other document files or software), and the time that you download it.

Although, in some circumstances, it may be possible to identify you from this information, we do not attempt to do so, and only use this information for statistical analysis, system administration, to assist with your use of the website and similar related purposes. This information is not disclosed to any other party.

A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time. We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing the website. The Peter Kittle Motor Company is not responsible for and does not endorse or approve the privacy, security or handling of your personal information via those third party websites or the content of those websites. This Policy does not apply to your use of those third party websites. You should review the privacy policy and terms of use for those third party websites each time you visit those websites.

Automated decision-making processes

As at the date of this Policy, we may use computer programs to make or do a thing that relates to the making of a decision using your personal information from time to time. This includes the circumstances where we use Google Sheets, random name generators or comment selectors to run competitions and/or customer surveys. In addition we may use artificial intelligence (AI) assisted tools which may include chatbots on our websites, or AI assisted service bookings over the phone.

Overseas Disclosure of Your Personal Information

From time to time, there may be circumstances where we may disclose personal information that is not credit related information to overseas recipients in order to provide our products and/ or services to you and for administrative or other management purposes. Our business is affiliated with other third party businesses with headquarters and related entities located overseas, such as vehicle manufacturers and original equipment manufacturers or other related suppliers that we use in providing our products and services to you and they may disclose your personal information to their headquarters or related companies located overseas. In the course of doing business with you, we are likely to disclose some of your personal information that is not credit related information to overseas recipients . However, we will only do so where:

(a) it is necessary to complete the transaction you have entered into; and

(b) you have provided consent; or

(c) we believe on reasonable grounds that the overseas recipient is required to deal with your personal information by enforceable laws which are similar to the requirements under the APPs; or

(d) it is otherwise permitted by law.

If in future we do propose to disclose credit related information overseas, we will do so in compliance with the requirements of the Privacy Act. While it is not practicable to list every country in which such recipients may be located, recipients of such disclosures are likely to include countries where the parent company of our franchisors, distributors or financiers exist (including Japan, South Korea, China, USA, Singapore, Sweden, the United Kingdom, India, Ireland, the Philippines and Vietnam) and we will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.

By providing your personal information to us, you consent to us disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business.

If you do not want us to disclose your information to overseas recipients, please let us know.

Access to and Correction of Personal Information

You may access your personal information by contacting us. You can contact our Privacy Officer on the email addresses below to make this request. We will then arrange with you a convenient time and means for you to have access. On the rare occasions when we refuse access, we will provide you with a written notice stating our reasons for refusing access. We may seek to recover from you reasonable costs incurred for providing you with access to any of the personal information about you held by us.

If at any time you believe that any personal information of yours that we hold is incorrect, please contact us and advise us of the correct information, and we will amend our records. We are not obliged to correct any of your personal information if we do not agree that it requires correction and may refuse to do so. If we refuse a correction request, we will provide you with a written notice stating our reasons for refusing.

We will respond to all requests for access to or correction of personal information within a reasonable time and will endeavour to do so within 30 days.

Complaints

You may lodge a complaint with us if you believe that we have handled your personal information other than in accordance with the Privacy Act, APPs or the Credit Reporting Code. To do so please contact our Privacy Officer via the contact details below. We will confirm receipt of your complaint and set out the time frame we require to investigate your complaint and provide you with a response. We will acknowledge your complaint within 7 days and will endeavour to respond as quickly as possible, which generally, will be within 30 days of receiving your complaint.

In the event that you are dissatisfied with the outcome of the complaint of the investigation, you may refer your complaint to the Office of the Australian Information Commissioner:
